1.- COMPANY ORGANIZING THE PROMOTION

The Company Greenmotiv SL with address at c/ Consell de Cent 113-115, entresuelo 1ª, 08015, Barcelona, and identified with the number B66485541 organizes a collaborative Sweepstakes of a Tablet (hereinafter, “the Promotion”) of national scope, to be developed through the Internet, exclusively for users residing in [especificar ámbito territorial] in accordance with the provisions of the participation requirements section. The purpose of this sweepstakes is to reward the loyalty of the brand’s followers.

2.-START AND END DATES

The Promotion begins on March 4, 2022 and ends on March 31, 2022 (both inclusive). The Company reserves the right not to proceed with the promotional action if by the reflected starting date of the promotional action there has not been a participation of more than 300 people. Likewise, the Company may extend the termination of the promotional action for 1 more week, being the new termination date April 2, 2022 in case a higher number of 150 participations is registered.

3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION

The requirements for participation are as follows:

– Participation is open to those who reside in Spain and are of legal age.

– Only Participants who have an Instagram account are eligible to participate.

– Participants must follow the profiles of Annabis (@annabis.es), Enecta (@enecta.es) and Vetercann (@vetercann.es).

– Participants must comment on the brand’s post on the social network Instagram (on at least 1 of the 3 profiles mentioned above) tagging 2 real (non-promotional) accounts during the participation period.

– Entrants may only participate with a single Instagram profile. If a Participant is found to be participating with multiple Instagram profiles they will be disqualified.

– Even if Participants write several comments on the same post, they will only participate with a single entry in the random drawing.

– The application will accumulate mentions of the same Participant even if they are in different comments.

CONDITIONS OF THE PROMOTION AND PRIZES

The winner will be chosen randomly through the Easypromos platform. The winner will be announced the week of March 14 through the brand’s social profiles, along with the certificate of validity of the sweepstakes. The prize will be a Samsung Galaxy Tab A7 Lite.

The prize may not be exchanged for cash or any other prize, nor may it be subject to change or alteration. The Company reserves the right to modify the prize if on the day of declaring the participant as winner there are problems of stock of the same and, therefore, impossibility to give the same. The winner may contact the Company within 5 business days from the date the winner is announced via email. If no such contact is made within the stipulated period, the draw will be declared void. The holding of the draw and the awarding of the prize are subject to the tax regulations in force.

5.- DISQUALIFICATIONS AND PENALTIES

If it becomes evident that any of the Participants do not comply with the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion and will lose all rights to the prizes awarded by virtue of this Promotion. The Company reserves the right to declare the draw void.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honor, to personal and family privacy and to one’s own image will not be allowed. We will not be responsible for any damage caused by comments made by Participants in the Promotion, which at any time may offend the sensibilities of other Participants. The participation in this Promotion, as well as the publication of comments made by Participants in the publications may not violate under any circumstances the Instagram Community Rules or the Instagram Terms of Use. If fraudulent means of participation, such as the use of bots in the comments, are discovered by the Company, the prize will not be awarded and will remain the property of the Company.

7.-EXONERATION OF LIABILITY

By way of example, but not limited to, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the Participant with respect to the prize obtained from this Promotion. We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend the same, including the participation web page.

8.- PROTECTION OF PERSONAL DATA

The Company responsible for the treatment of your data is Greenmotiv SL, with address at c/ Consell de Cent 113-115 Entresuelo 1, 08015, Barcelona and identification number B66485541. In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Bases consents that their personal data will be incorporated into a file, owned by it, in order to manage the draw, as well as disseminate and publicize its results, and process the delivery of the prize. Please note that you can exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability, forgetfulness and not to be subject to automated individual decisions by sending an e-mail to hola@greenmotiv.com or by letter to the following address: c/ Consell de Cent 113-115 Entresuelo 1, 08015, Barcelona, enclosing in both cases a copy of an identification document. Without prejudice to any other administrative remedy or judicial action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not lawful, as well as in case he/she does not see his/her rights satisfied. Therefore, the Participant declares to have been informed of the conditions on the protection of personal data by accepting and consenting to the processing.

9.- CHANGES AND ACCEPTANCE

We reserve the right to modify or extend these promotional terms and conditions, to the extent that it does not prejudice or undermine the rights of the Participants in the Promotion. The mere fact of participating in the sweepstakes implies that the Participant fully accepts the conditions of these Terms and Conditions. Likewise, participation in a sweepstakes of this nature implies acceptance of the rules of the social network Instagram through which the sweepstakes takes place.

10.- APPLICABLE LAW AND JURISDICTION

These terms and conditions shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of residence of the Participant shall have jurisdiction to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
